Terms and Conditions

These Terms are between you and Brian Alexander Perez, an individual based in Jacksonville, Florida, United States, who operates Often (“Often,” “we,” or “us”). They describe the terms for using Often's app and account-based services.
By using the service, you agree to these Terms. Our Privacy Policy explains how we handle information. Agreement to these Terms does not itself grant Apple Health permissions or consent to marketing emails.
1. Who may use Often
The account-based service is intended for United States residents who are at least 18 years old. You must meet those requirements and provide accurate information when asked. We do not independently verify your identity or age. Contact dev@often.so if you believe an eligibility decision is mistaken.
We may close an account that does not meet these requirements, with notice and an opportunity to export data where reasonable and permitted by law. Public workout and plan links may be viewed without an account.
2. Your account
Keep your password confidential and notify dev@often.so if you believe someone has accessed your account without permission. Do not share or transfer your account or use another person's account without authorization. You are responsible for your use of the service, subject to applicable law.
We may require an app update to continue using features or maintain compatibility and security.
3. TestFlight and service availability
Often is currently offered through Apple's TestFlight for testing. Features may change, stop working, or become unavailable. Testing can involve errors or data loss. Keep separate copies of important information using the export features available to you.
TestFlight is provided by Apple under Apple's terms. Apple may collect diagnostic information and feedback under its own settings and policies.
4. Your content and sharing
You retain ownership of content you create or upload. You give us permission to store, process, back up, display, and transmit that content as needed to provide the features you use. For content you choose to publish, this includes making it available through public links. This permission does not grant us a general right to use private workouts or health information for advertising.
You are responsible for having the rights and permissions needed for your content.
Publishing a workout or plan can make its title, description, exercises, programming details, schedules, and your display name, username, and avatar visible to anyone with the link. A plan can include workout templates that have no separate public link. Links can be forwarded, and edits may update the same page.
Profile photos are served through public image URLs even when profile settings are private. Use sharing controls to make a public link private and wait for confirmation. Local deletion, particularly while offline, should not be treated as confirmation that a public page has been removed. Contact dev@often.so for help with a link. Copies other people have saved are outside our control.
Do not publish unlawful content, threats, harassment, sexually explicit material, impersonation, content that infringes others' rights, or other people's personal information without appropriate permission. We may remove content or restrict sharing when these rules are violated. Report a page by emailing dev@often.so with its URL and an explanation.
5. Exercise and health features
Often is a workout-planning and tracking tool, not medical advice or a substitute for a qualified professional. Exercise carries risks. Choose activities appropriate for your circumstances, consult a qualified professional when needed, and stop exercising if you feel unwell.
Apple Health and Apple Watch features depend on the permissions you grant and the availability of supported devices. Information may be incomplete or inaccurate. Manage permissions in Apple's settings. Withdrawing permission does not itself erase data already saved in Often or Apple Health.
6. Acceptable use
Do not access another person's data without authorization, interfere with the service, overload its systems, distribute malicious code, bypass access controls, create accounts through unauthorized automated means, or scrape public pages at scale. Do not use Often for unlawful purposes.
7. Ending use or deleting your account
You may stop using Often or delete your account through the app. Removing the app alone does not delete your account. Account deletion, backup retention, image cleanup, and data remaining on other devices are explained in the Privacy Policy.
We may suspend or close an account for violations of these Terms, security reasons, or legal requirements. Where reasonable and permitted, we will provide notice and an opportunity to export information. Some retained records may remain as described in the Privacy Policy and applicable law.
8. Disclaimers
To the extent permitted by applicable law, Often is provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or freedom from errors. Nothing in these Terms excludes a warranty, remedy, or liability that cannot lawfully be excluded, or limits your mandatory consumer rights.
9. Governing law
These Terms are governed by Florida law and applicable United States federal law, except where mandatory protections of another jurisdiction apply. These Terms do not require arbitration or waive participation in a class action.
10. Changes to these Terms
We may update these Terms as Often changes. Updated Terms will be posted at https://often.so/terms-and-conditions with an updated date. We will provide notice of material changes and obtain agreement where required by applicable law.
